Luxury Oceania Cruise Official Contest Rules


The Contest (“Contest”) is open to legal residents of the City of Toronto in the province of Ontario (except as noted herein) who have reached the age of 18 on the date that they entered the Contest. Void where prohibited by law. Employees, directors, and officers of Liberty Tax Service Canada (“Liberty Tax”), its franchisees, Cruise Connections Canada, and Oceania Cruises and/or their respective parent companies, affiliates, franchisees, subsidiaries, distributors, representatives, advertising and promotional agencies, agents, sponsors, and any entity that they contract with specific to the Contest, as well as the immediate family members, and any persons domiciled with any of the above (whether related or not), are not eligible to win the Prizes (“Excluded Entrant”). To be eligible, you must provide your name, address phone number, and a valid email address.

How to Enter

NO PURCHASE NECESSARY. You may enter the Contest by properly competing the paper ballot, including the submission of your full name, address, phone number, and a valid email address, at participating Liberty Tax Service locations in the City of Toronto, Ontario as set forth below:

Alternatively, individuals can mail a 3-inch by 5-inch card with the following information: full name, address including Postal Code, phone number, valid email address, and the statement “I agreeing to the rules of the contest” and with their signature. Mail the card to: Liberty Tax Service, 1714 Danforth Avenue, Toronto, ON  M4C 1H8. The card must be received during the Contest Period (as defined below). In the event it is discovered that any individual attempted to enter the Contest more than once, all additional entries by that individual will be disqualified from this Contest.


The Contest runs from February 5, 2018 at 12:01 a.m. Eastern Standard Time (“EST”) and ends on May 18, 2018 at 11:59 p.m. EST (the “Contest Period”).

Prize Description

The Contest will award one prize with an aggregate value of CAD $6,100 consisting of: an Oceania Cruise for 2 people including airfare, transfers, 4 port excursions and a CAD $200 shipboard credit (collectively, the “Prize”) and the winner is responsible for these costs and any other incidentals they purchase.  Prize does not include insurance, passports or any visas required. The Prize must be commenced by November 1, 2018 and completed by March 31, 2019. Liberty Tax Service will assist with booking of the Prize through Cruise Connections Canada.  No substitution for, or transfer of the Prize will be allowed, except at the option of the Contest Sponsor in the event of Prize unavailability. The Prize will be delivered only to the confirmed winner.


The odds of winning are dependent on the total number of eligible entries received during the Contest Period.

Draw Details

A random draw from all eligible entries received during the Contest Period (the “Draw”) will occur at the 1714 Danforth Avenue, Toronto office of Liberty Tax on May 24, 2018 at 12:00 p.m. You do not need to be in attendance to be selected.

Winner Contact Details & Claiming the Prize

If you are chosen to be eligible to win the Prize, Liberty Tax will attempt to contact you for a period of 5 days after the Draw at the email address and/or telephone number you specified when entering the Contest. In order to be declared the winner, you must then correctly answer without assistance a time-limited mathematical skill testing question and sign the Release form (the “Release”), as provided below. The original copy of the Release may be signed at that time or taken away and returned within 5 days. Upon verification of the completion and correctness of the answer to the skill-testing question and execution of the Release, you will be declared the winner. The winner is responsible for all costs incurred in claiming or using the Prize described in the Contest rules.

Forfeit of Prize

If you cannot be reached within the 5 days of the Draw, do not answer the skill testing question correctly, unaided, or within the prescribed amount of time, fail to submit the Release within 5 days of being informed of your eligibility to win the Prize, or otherwise fail to comply with these Contest Rules, then the Prize will be forfeited and another entry will be randomly selected from among the remaining eligible entries as per these Contest Rules. This process of selecting a Prize winner will be repeated until the Prize eligible to be won has been awarded.  If the Prize is not awarded by August 1, 2018 for any reason whatsoever, it will be voided.

Use of Personal Information

By entering the Contest and voluntarily providing your personal information as described in these Contest Rules, you agree to the collection, use and disclosure by Liberty Tax, its franchisees, and their respective employees and/or authorized agents, of your personal information, for the purpose of administering the Contest, including—but not limited to—contacting you with respect to the Contest winner and to receive Liberty Tax Canada marketing materials of which you can unsubscribe at any time.. Personally, identifiable information will only be used to administer the Contest and for no other purpose, except as specifically outlined in these Contest Rules. Personally, identifiable information will not be sold, shared or disclosed by Liberty Tax to any third party, other than for the purpose of administering the Contest, or if required by law with the exception that aggregated information may be used by or shared between Liberty Tax, Cruise Connections Canada, and Oceania Cruises.

Publicity Consent

By entering the Contest, you agree that if you are determined to be a winner, Liberty Tax may use your name, comments, voice, likeness, municipality of residence and picture in any advertising, Contest, or publicity carried out now or in the future, on a global basis, without compensation or notice and you grant Liberty Tax any and all rights to such use. This provision extends to any photographs or videos that are submitted by the winner to Liberty Tax.

Limitation of Liability/Release

By participating in the Contest, and as a condition of acceptance of the Prize, you, your heirs, executors, administrators, successors and assigns, release and forever discharge and agree to defend, indemnify and hold harmless Liberty Tax, and its affiliates, subsidiaries, successors, assigns, agents, advisors, franchisees, shareholders, partners, representatives, its advertising, Contest and fulfillment agencies and its employees, officers, directors, agents and representatives (collectively, the “Released Parties”), from and against any and all losses, damages (including, without limitation, direct, indirect, incidental, consequential or punitive damages), rights, claims, actions, causes of action, personal injury, property damage or death, including without limitation all costs and liabilities of any kind including legal fees on a substantial indemnity scale, hereinafter called “Claims” and including without limitation any claims arising from any act of negligence of the Released Parties, that you now have, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Contest, or the awarding, acceptance, possession, use, or misuse or enjoyment of any Prize, and where applicable, traveling to, preparing for, or participating in, any Contest-related or Prize-related event or activity; or (ii) the publicity rights granted to Liberty Tax.

Compliance with Rules

By entering the Contest, you agree to abide by the entire Contest Rules and the terms and conditions under which the prize is awarded. Any decision made by Liberty Tax in respect of this Contest shall be final.

Technical Issues

Liberty Tax, and its affiliates, subsidiaries, successors, assigns, agents, advisors, franchisees, shareholders, partners, representatives, its advertising, Contest and fulfillment agencies and its employees, officers, directors, agents and representatives, shall not be responsible for any injuries, loss or damages of any kind including, but not limited to, compensatory, direct, incidental, consequential or otherwise, with respect to, or in any way arising from, this Contest or the Prize awarded, including but not limited to: (i) lost, stolen, not received, destroyed, damaged, misdirected, illegible, incomplete, fraudulent or late entries which will be void and not eligible; (ii) failure to receive entries for any reason or technical failures or errors of any kind. A Prize winner's refusal or inability to accept the Prize awarded shall release Liberty Tax from all obligation. In no event shall Liberty Tax be held to award more prizes than what is mentioned in these Contest Rules or to award prizes otherwise than in compliance with these Contest Rules.

Rights to Terminate/Modify/Suspend Contest

Liberty Tax retains the right, in its absolute discretion, to suspend, modify or terminate any aspect of the Contest (including, but not limited to these Contest Rules) at any time. The Prize must be accepted as awarded with no substitutions. Liberty Tax may make substitutions of equivalent kind or value in the event of the unavailability of the Prize (or component thereof) in its sole discretion for any reason whatsoever. Liberty Tax may terminate or withdraw this Contest at any time by posting a notice. If the Contest is terminated on any day prior to the normal Contest end date (the “Termination Date”), Liberty Tax may determine the winner from all eligible entries received as of the close of business on the Termination Date (which winner shall be randomly selected in accordance with these Contest Rules).

General Disqualification

Any attempt made by an entrant or other individual or entity, to deliberately damage, manipulate or undermine the legitimate operation of the Contest, including but not limited to any fraudulent claims, is a violation of the law. Liberty Tax reserves the right to seek remedies and damages from any such individual or entity which makes any such attempt. Any entrant who, in the opinion of Liberty Tax, is determined to be engaging in any of the foregoing activities will be immediately disqualified from the Contest. In the event that a potential winner is disqualified for any reason, the Prize may be awarded to an alternate winner from among all remaining eligible Contest entries.

Role of the Party

Liberty Tax is the sponsor of the Contest.

Entries Become the Property of Liberty Tax

All entries become the property of Liberty Tax upon submission and will not be returned.


The Contest is governed by the laws of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited by law. Participation constitutes your full and unconditional agreement to these Contest Rules and the decisions of Liberty Tax, which are final and binding in all matters related to the Contest. By entering the Contest, you agree that the courts of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of this Contest’s Rules or the running of this Contest.
